At this hearing Blacksburg VA's Board Of Zoning Appeals discussed and voted on the appeal filed by Attorney John Spicer in regard to a decision by the Zoning Administrator regarding an occupancy Zoning Violation [ZV 11-0038] at 207 Penn Street. Mr Spicer was acting on behalf of absentee property owner Cheryl A. Boone of Lutherville, MD 21093, The local Property Manager Ann Moore of Blacksburg Real Estate of 401 South Main St #102 Blacksburg, VA 24060 and the tenants of the property.

According to the Attorney, Ms Boone choose to remain "out of state" and Ms Moore was unavailable, even though the office of Blacksburg Real Estate office is directly across the street from the location of the hearing.

Blacksburg's Board of Zoning Appeals did right by the residents of downtown Neighborhoods today while mitigating concerns about the perception that the town development staff can be difficult to work with.

It was refreshing to hear the members express their concerns about the undue length of time that this process took to reach resolution. They recognized that the evidence made it clear that the applicants had abused the appeal process to forestall timely enforcement and reveled a flaw in need of correction the next time the process is reviewed.
